HUMAN RIGHTS AND THE INSTITUTION OF MARRIAGE

          The equal and inalienable rights of all human beings provide the foundation for freedom, justice and peace in the world.  The Human Rights based approach focuses on those who are marginalized, discriminated and excluded.While addressing an issue based on human rights focus is given to gender norms and power imbalances in society. The Human Rights based approach emphasises that people are actors in their own development rather than passive recipients of service.Human rights is basic to human to life.
          But all these values fade into the background while considering marriage as an institution. In the 21st century Indian context marriage is one of only a handful of events where casteism, elitism and classism can be showcased without any public outrage. These social evils are perpetuated at the expense of the bride and the groom.
          Marriage , in the Indian context is an event of the community rather than an event of the couple. In our everyday life we encounter instances where the society voluntarily stimulates  the family to look for alliances. These actions stem from a lack of awareness about basic human rights and human nature. Most families look for alliances from within their social caste and social class, again with complete disregard to the aspirations of the people who are supposed to marry. The rights of these people are violated mundanely.
         This is even worse when considering the marriage rights of women. Most often their opinions have no value and their aspirations have no backing in the family. Their marriage is often considered as a burden. These streams of thought and action is deep rooted in customs and beliefs that are tone-deaf to the idea of human rights.
      The rights based approach provides an opportunity for emancipation and strengthening of human rights. Gender norms in marriage when analysed under the human rights approach will highlight the basic disparity in the right of choice. Developing human rights into a level where it penetrates all walks and stages of life is the need of the hour.
